July 28, 2009

The City of Owen Common Council met in regular session on Tuesday, July 28, 2009 at 7:00 p.m. at City Hall. Mayor Timothy Swiggum presided and City Clerk/Treasurer Terri Ernst served as secretary. Present Alderpersons: Tolzmann, Lulloff, Shelton and Heggemeier. Absent were Riihinen and Lorence. A quorum being present, the meeting was called to order. Also present were Deputy City Clerk/Treasurer Cindy Cardinal.

Approve Minutes
A Tolzmann/Lulloff motion and subsequent vote approved the minutes for the 7/14/09 meetings.

Public Opinion
Present: Kirk Skoog of MSA Professional Services. The railroad cut the tall grass between 4th and 5th Street along the rail. Prices were gathered for pedestrian crossings. Add to the next agenda.

Dog Rescue Shelter
A Shelton/Heggemeier motion and subsequent vote approved that dog rescue shelters will not be allowed in the City limits.

Annexation
A Shelton/Lulloff motion and subsequent vote approved under s. 66.0217 Wis. Stats. to annex property to the City of Owen and to detach it from the Town of Green Grove and the Town of Hoard.

TID #4
A Heggemeier/Tolzmann motion and subsequent vote approved Resolution #2009-14 to amend TIF #4 and Project Plan.

Environmental Assessment
A Lulloff/Heggemeier motion and subsequent vote approved to proceed with the Phase 1 Environmental Assessment for the Owen Mfg. property for up to $3,300 requested to be paid by the owner. If the owner is unable to pay, the City will cover the expense.

New CDA Member
No action.

Zoning Report
A Shelton/Heggemeier motion and subsequent vote approved Resolution #2009-15 Real Estate Sales Agreement and Exhibit A Covenants selling Lot 4 of Country Side Estates to RCD Holdings LLC.

Resolution Clarification
At the 7/14/09 Council meeting, an amendment to the liquor ordinance was passed under Resolution #2009-12. The Resolution should be correctly recorded as #2009-13. A Tolzmann/Shelton motion and subsequent vote approved the change.

Parks & Rec. Committee
Ron Fredrickson has been asked to construct two message boards for the Mill Pond and Crowley Park for $1,000. The next Parks and Rec. meeting will held on Wednesday, Aug. 5, 2009 at City Hall. The Goose B-Gone Product is being applied to the lawn along the Mill Pond. The application is pretty easy with the use of a four-wheeler and it should be addressed again in the Spring of 2010. The City Attorney will be proposing to the Railroad that the City acquire the burned railroad bridge and rail right away property for $1.00 with the City assuming all liability. Question was raised regarding the rail property by the depot and Owen Public Library.

Vouchers
A question was raised and answered regarding check #40594. A Tolzmann/Lulloff motion and subsequent vote approved paying the following vouchers: City Pooled 40565-40611, City Total $53,537.22, Water Total $306.48 and Sewer total $2,025.48.

Adjourn
A Shelton/Heggemeier motion and subsequent vote approved to adjourn the 7/28/09 open session meeting at 8:05 p.m.
