June 8, 2010
The City of Owen Common Council met in regular session on Tuesday, June 8, 2010 at 7:00 p.m. at City Hall. Mayor Timothy Swiggum presided and City Clerk/Treasurer Terri Ernst served as secretary. Present Alderpersons: Tolzmann, Lulloff, Kiviko, Lorence and Heggemeier. Absent was Riihinen A quorum being present, the meeting was called to order. Also present were Deputy City Clerk/Treasurer Cindy Cardinal, Police Chief Randy Poirier, Officer Bradley Tatro and DPW Gary Smith.
Approve Minutes
A Tolzmann/Lulloff motion and subsequent vote approved the minutes for the 5/25/10 meeting.
Treasurer’s Report
A Lorence/Heggemeier motion and subsequent vote approved the Treasurer’s report for May 2010.
Police Report
A Heggemeier/Tolzmann motion and subsequent vote approved the Owen-Withee Police report for May 2010. Chief Poirier received notification that there is an uncovered manhole opening at the Owen Mfg. building site where the kiln has been recently removed. Clerk Ernst will call Marvin Matejka and make him aware of this hazard.
Outside Employment
A Tolzmann/Lulloff motion and subsequent vote approved Officer Bradley Tatro to work at the Athens Fair August 20th and 21st which his weekend off in Owen.

Public Hearing
The public hearing was opened at 7:11 p.m. by Mayor Timothy Swiggum for consideration of Sec. 13-2 Floodplain Zoning Ordinance. The Planning Commission met 6/8/2010 prior to Council and approved to recommend to the Owen Council to hold a Public Hearing to repeal and recreate Ordinance Sec. 13-2. The ordinance needs to be updated to include the newly revised FEMA floodplain maps. The new maps indicate that no Owen resident is in the floodplain. The public hearing was closed at 7:15 p.m.
Floodplain Zoning Ordinance
A Heggemeier/Lorence motion and subsequent vote approved to repeal and recreate Ordinance Sec. 13-2 Floodplain Zoning Ordinance in the Code of Ordinances for the City of Owen. This ordinance may be reviewed upon request at City Hall.
Ehlers Finance Proposals
Brian Reilly with Ehlers Financial Advisors joined the Council on speakerphone to discuss financing for infrastructure costs to the East Side Commercial Park and Agribusiness Park. Concerns were addressed what projects were priority and if the projects could be scaled back to the range of $750,000 in infrastructure costs. The possible sale of Lot #2 to Dee and Jerry Wells has now fallen through and the need for infrastructure construction now to the East Side Commercial Park has been postponed for now. A Lorence/Heggemeier motion and subsequent motion approved to table this issue until the next meeting.
E. Side Commercial Park Infrastructure
Mike Voss of MSA Professional Services presented to the Council probable cost sheets for infrastructure improvements to the East Side Commercial Park. Cost sheet (A) for $1,059,000 would provide all services to lots 1, 2 and 3 on the southern end of the park. Cost sheet (B) for $881,000 would provide all services to just lots 1 and 2. A Lorence/Tolzmann motion and subsequent vote approved to table this issue until the next meeting.
4th Street Sewer Rehab.
A Lorence/Tolzmann motion and subsequent vote approved for MSA Professional Services to move forward and advertise requests for bids on the 4th Street Sewer Rehab. Project.
Planning Commission Report
The Planning Commission met 6/8/2010 prior to Council and approved and recommended to the Owen Council that a Conditional Use Permit be allowed to Brandon Edblom at 783 N. West Street to allow a limit of 3 horses on his 15 acres in a UT District. A Heggemeier/Lorence motion and subsequent vote approved the Conditional Use Permit to Brandon Edblom as stated.
Owen Mfg. Property
Samples have been taken from the ground monitoring wells but the results have not come back yet. The kiln has been dismantled and removed by Midwest Hardwoods.
Fire Dept. Sign
Reported by Council member Mel Lorence, the Fire Dept. is proposing a new sign, bell tower and flag pole for in front of the Owen Fire Hall. Present cost estimates are at $1,500. A Lulloff/Kiviko motion and subsequent vote approved to table the issue to a future meeting.
Withee Water Rate
Effective 6/3/2010, the Village of Withee has raised their water rates by 3%.
Payroll Report
Presented were time cards for all employees for the pay period of 5/1/10 through 5/28/10. A Lorence/Lulloff motion and subsequent vote approved the report. Payroll reports will now be presented to Council at the end of each quarter.
Disbursements
A question was raised and answered on Check #41751. A Heggemeier/Tolzmann motion and subsequent vote approved paying the following checks: City Pooled 41719-41773. City Total $37,235.80, Water Total $12,312.19, Sewer Total $9,265.95.
Adjourn
A Kiviko/Lorence motion and subsequent vote approved to adjourn the 6/8/10 open session meeting at 9:23 p.m.
