The City of Owen Common Council met in regular session on Tuesday, November 23, 2010 at 7:00 p.m. at City Hall. Mayor Timothy Swiggum presided and City Clerk/Treasurer Terri Ernst served as secretary. Present Alderpersons: Tolzmann, Lulloff, Kiviko, Lorence, Riihinen, and Heggemeier (at 7:17 p.m.). A quorum being present, the meeting was called to order. Also present was Deputy City Clerk/Treasurer Cindy Cardinal.

Approve Minutes
A Tolzmann/Riihinen motion and subsequent vote approved the minutes for the 11/9/10 meeting.

Public Opinion
Present: Linda Wyeth-OW Enterprise and Tony Suda. Tony Suda asked what was going to be done about the bridge that floated down the river. The City is presently working with FEMA to replace and remove the bridge. Suda also asked if the budget included money to repair the roofs on the buildings in the Mill Pond Park. There is no money in the 2011 budget but the Parks and Rec. Committee is working on a project plan to improve or replace the buildings sometime in the future. Suda also commented that he did not want to see the development happening on the East side of the City to become a tax burden to taxpayers. Mayor Swiggum advised Suda that the cost of the infrastructure that is presently being constructed will be paid for by the tax increment from tax incremental district #4. Mayor Swiggum explained that the 2011 Budget has gone down 2.45% from last year and the City’s mill rate at this point, before the school credit, is down 4 cents at $11.54/1,000 compared to last year at $11.58/1,000. The amount of school credit has not been received yet from the WDOR. The final mill rate, after school credit, is multiplied per $1,000 total assessed value of property.

Resolution #2010-16
City Clerk Ernst presented Resolution #2010-16 establishing a public fire protection charge. A few Council members commented that citizens were questioning why the Owen-Withee-Curtiss Fire Dept. is adding a PFP charge to all Owen utility customers. The public fire protection charge does not involve the fire department. The PFP charge, also known as hydrant rental charge, recovers the cost of water for fighting fires and the extra capacity built into the system necessary to rapidly deliver a large volume of water to a fire anywhere within the municipality's water service area. These costs include a portion of the wells, pumps, storage facilities, water mains, hydrants and an estimated quantity of water used for this purpose. A Heggemeier/Lulloff motion and subsequent vote approved Resolution #2010-16. The resolution may be viewed upon request at City Hall or at www.cityofowen.com.

Public Hearing
The public hearing was opened at 7:28 p.m. by Mayor Timothy Swiggum for consideration of the City’s 2011 Budgets. Clerk Ernst reported that there were three changes to the budget for Police Dept. wages, Public Works wages and sewer lining project. After explanation by Ernst for the changes, the Council changed the Police Dept. wages back to the previous amount and encouraged all officers to keep their hours at 80 hours per pay period unless necessary under the supervision of the Police Chief. The changes to Public Works wages and the sewer lining project was kept the same. The public hearing was closed at 7:55 p.m.

2011 Budgets
A Tolzmann/Riihinen motion and subsequent vote approved the 2011 City Budgets as follows: City General $1,128,264.38, Owen Lake District $129,695, Owen Sewer Utility $475,700 and Owen Water Utility $551,300. The 2011 City General Budget may viewed upon request at City Hall or at www.cityofowen.com.

CDA Update
Chairman Steve Heggemeier reported on the minutes of the 11/17/10 CDA meeting. Rebecca Baumann was present to introduce herself as the new executive director of CWAIC. Baumann reported on the first tenant of the Agribusiness Innovation Center, Cherney Microbiological, and other meetings and correspondences she and other CWAIC board members have had with possible future tenants and possibly a Charter School that the Innovation Center can provide classroom space to. Mayor Swiggum reported that Gestamp is no longer interested in the OMI property. Gestamp is interested in signing a letter of intent for the 38 acres in the East Side Commercial Park. Swiggum is presently working on that letter along with Sheila Nyberg of the Clark County Economic Development Corporation. The Gestamp plant would be valued at $100 million. Update FEMA visit
Denny Lulloff reported that two representatives from FEMA met at City Hall along with Director of Public Works Gary Smith and Clerk Terri Ernst on 11/15/10. Clark County has been declared a Federal Disaster Area from the heavy rains on September 23, 2010. The only damage within the City was the walking trail bridge being washed down the Popple River. Replacement of the bridge costs will be covered by FEMA at 75% and Wisconsin Emergency Mgmt. at 12.5% and the remainder by the City of Owen.

Lease City property
Mayor Swiggum reported that Steve Travis who recently moved to Owen from Ohio is interested in leasing some land for his auto repossession business. Swiggum explained that in previous years the City has temporarily leased land by the City garage. The issue will be brought back at the next Council meeting.

Operator’s License
A Heggemeier/Tolzmann motion and subsequent vote approved an operator’s license for Teresa Goessl.

Disbursements
A question was raised about Check #42381 and answered. A Tolzmann/Lorence motion and subsequent vote approved paying the following checks, City Pooled 42343-42384: City Total $168,711.72; Water Total $909.88; Sewer Total $581.10.

Adjourn
A Lorence/Kiviko motion and subsequent vote approved to adjourn the 11/23/10 open session meeting at 8:33 p.m.
